What is a vocational consultant?


A vocational consultant is an expert in the areas of vocational rehabilitation, vocational and earning capacity, lost earnings, and more. Consultants perform evaluations of civil litigation, as a facet of economic damages. Vocational consultants determine what the person could have earned before the incident, and compare it to what they’re likely to earn after the incident. A vocational consultant is typically hired by an attorney, but does not testify.

How do you become a vocational consultant? 

 

To become a vocational consultant, you usually need at least a Master’s degree in counseling or a closely related Human Services field. Experience in the vocational rehabilitation field, and vocational evaluation is typically required. Sometimes a CRC Certification (Commission on Rehabilitation Counselor Certification) is required to become a vocational consultant. 

 

What is a vocational evaluation? 

 

A vocational evaluation is a process in which a vocational consultant meets with an individual to gather information to evaluate that person’s vocational potential. This process is done through a combination of interviews, vocational testing, situational assessments, records reviews, and resource surveys. An individual might contact a vocational consultant to know which jobs, fields of interest or ability, vocational training, or courses of study might be right and beneficial to them. Vocational evaluations are usually used when someone has been injured or is going through a divorce. Evaluations can be requested by an individual, a lawyer, or an insurance company. What is an earnings capacity assessment? 

 

An earnings capacity assessment is a tool commonly used for life insurance/income protection claims. This assessment works to establish a person’s economic loss and provides recommendations on a person’s ability to work, functional capacity, personality, and work readiness. Many different types of people seek out vocational consultants for an earnings capacity assessment. Unemployed, disabled, or underemployed spouses occasionally have earnings capacity assessments. Many spouses that have been out of the competitive labor market because of child care or other reasons can receive an evaluation regarding their ability to use previous skills, employment, and education on their quest to return to the local labor market. An earnings capacity assessment will help determine the spouse’s highest level of employability and future earnings. If a disabled spouse that states a medical or psychological disability will prevent them from working, an evaluation from a vocational consultant can assess their vocational capacity and ability to be employed. These assessments can be used in court during divorce or other civil disputes. During a divorce, the lifetime costs of a disabled child are sometimes calculated into the financial settlement. By researching the cost of required medical services in the local area, a vocational consultant can evaluate the long term medical costs. This assessment can also be used in court during divorce proceedings.

 

When would I need to get an earnings capacity analysis? 

 

An Earnings capacity analysis is usually undertaken in situations where an individual’s ability to earn wages is in dispute, like in divorce matters in which alimony or other support monies are being established. It involves interviewing the individual in question to get information about his/her socio-educational background, general health, work history, skills, aspirations,  and overall motivation. This information is then considered within the context of a selected market to get an opinion regarding the maximal earnings that a specific person could expect to achieve and replicate over time. Often these cases also involve assessing whether or not vocational retraining (i.e. formal schooling and/or obtaining other forms of vocational credentials) can allow an individual to enhance upon their earning capacity; if retraining is practical, problems with length and price of the program, are typically addressed. Loss of earnings capacity assessments are used when establishing the number of vocational damages in personal injury and workers’ compensation cases. A loss of earnings capacity assessment typically encompasses a "before and after" comparison of a person’s ability to earn wages and access the labor market. The factors that are taken into consideration amongst others are usually education, training, overall patterns of workforce participation.
